1. Introduction

Welcome to Valerio & Co. These Terms of Service ("Terms") govern your access to and use of valeriosa.co.za (our "website") and your purchase of any products from us. By browsing our website or placing an order, you agree to be bound by these Terms.

Please read them carefully, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, which form part of these Terms. If you do not agree with any part of these Terms, please do not use our website.

Nothing in these Terms is intended to limit or exclude any rights you may have under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), or any other applicable South African law.

In these Terms, "we", "us", and "our" refer to Valerio & Co, and "you" and "your" refer to the person accessing our website or placing an order.

3. Eligibility

To place an order with us, you must be at least 18 years old and legally able to enter into a binding agreement. By placing an order, you confirm that you meet these requirements. If you are under 18, you may only use our website with the involvement of a parent or guardian.

4. Our products

We take great care to describe and display our products as accurately as possible. Please note that colours and finishes may appear slightly different on your screen due to device settings, lighting, and photography, and this is not a defect.

All of our jewellery is crafted in 316L stainless steel with 18k PVD gold, and is designed to be waterproof and tarnish-free under normal wear. Product availability is not guaranteed, and we reserve the right to change, limit, or discontinue any product at any time.

5. Pricing and payment

All prices are shown in South African Rand (ZAR) and include VAT where applicable.

We make every effort to ensure that prices are correct at the time of publishing. If we discover a pricing error after you have placed an order, we will contact you to confirm whether you wish to proceed at the correct price or cancel the order for a full refund.

Payment can be made through the payment methods shown at checkout, including our Buy Now, Pay Later partners, Payflex and PayJustNow. Buy Now, Pay Later purchases are subject to the separate terms and approval of the relevant provider. We do not store your full card details, and card payments are processed securely by our payment providers.

6. Buy 1 Get 1 Free offer

From time to time, and as part of our standing offer, selected purchases may include a complimentary second piece ("one to keep, one to give"). Unless stated otherwise, this offer applies automatically at checkout where eligible, cannot be exchanged for cash or a discount, and may be varied or withdrawn at our discretion. Where a qualifying order is returned, any complimentary piece received with it must also be returned in its original condition, or its value may be deducted from your refund.

7. Placing an order

When you place an order, you will receive an email confirming that we have received it. This confirmation does not mean your order has been accepted.

A binding agreement of sale only comes into effect once we have accepted your order and dispatched your item. We reserve the right to decline or cancel any order before dispatch, including where an item is out of stock, where there has been a pricing or product error, or where we suspect fraud or a breach of these Terms. If we cancel an order you have already paid for, we will refund you in full.

8. Shipping and delivery

We offer nationwide delivery across South Africa for a flat rate of R99, with free delivery on all orders over R799. Orders are typically processed within 1 business day, and delivery usually takes 1 to 4 working days once dispatched.

Full details are set out in our Shipping Policy, which forms part of these Terms. Delivery times are estimates and may be affected by factors beyond our control. We cannot be held responsible for delays or failed deliveries caused by incorrect or incomplete address details provided at checkout.

9. Returns, refunds, and exchanges

We accept returns within 30 days of delivery, provided the item is unworn, in its original condition, and includes all original packaging, tags, and accessories. For hygiene reasons, earrings can only be returned if they are defective or damaged on arrival.

Your full rights, including how to start a return, who pays for return shipping, and how refunds are processed, are set out in our Return & Refund Policy, which forms part of these Terms. Nothing in that policy limits your rights under the CPA.

10. Lifetime Warranty

Our Lifetime Warranty covers manufacturing defects and issues arising from materials or workmanship, including discolouration, loss of plating, and faulty clasps or links under normal wear.

The warranty does not cover loss, theft, accidental damage, misuse, neglect, improper care, third-party alterations, or normal wear and tear such as scratches. The warranty is offered in good faith and is subject to a fair use policy. Full terms are set out in our Lifetime Warranty information, which forms part of these Terms.

11. Your use of our website

You agree to use our website lawfully and not to:

• use it in any way that is fraudulent, unlawful, or harmful;
• attempt to gain unauthorised access to our systems or interfere with the website's operation;
• copy, reproduce, or distribute our content without our written permission; or
• use our content, product images, or branding for any commercial purpose without our consent.

We may suspend or restrict access to our website at any time if we reasonably believe you have breached these Terms.

12. Intellectual property

All content on our website, including our name, logo, product designs, images, text, and overall look and feel, is owned by or licensed to Valerio & Co and is protected by South African and international intellectual property laws. You may not use, copy, or reproduce any of this content without our prior written consent.

13. Limitation of liability

Our website and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, and without limiting your rights under the CPA, we are not liable for any indirect, incidental, or consequential loss arising from your use of our website or products.

Nothing in these Terms excludes or limits our liability for any matter where it would be unlawful to do so, including liability for gross negligence or for any implied warranty that may not be excluded under the CPA.

14. Links to other websites

Our website may contain links to third-party websites, such as social media platforms and our payment providers. We are not responsible for the content, products, or privacy practices of those websites, and a link does not imply our endorsement of them.

15. Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA), and forms part of these Terms.

16. Changes to these Terms

We may update these Terms from time to time to reflect changes in our practices, our products, or the law. Any updates will be posted on this page with a revised "last updated" date, and will apply to orders placed after that date. We encourage you to review these Terms periodically.

17. Governing law

These Terms are governed by the laws of the Republic of South Africa, and any dispute arising from them is subject to the jurisdiction of the South African courts. This does not affect any rights you may have to approach the relevant consumer authorities.
